Radiance Electrical Terms and Conditions Policy

Scope

These Terms and Conditions (“Terms”) apply to all contracts for the supply of goods and services by RADIANCE ELECTRICAL SERVICES PTY LTD ABN 91 659 810 812 (“Radiance”) to its customers.

Definitions

In these Terms, unless the context otherwise requires:

“Customer” refers to the person or entity who engages Radiance to supply goods or services.

“Goods” refers to any goods supplied by Radiance to the Customer.

“Services” refers to any services supplied by Radiance to the Customer.

Acceptance of Terms

By engaging Radiance for the supply of goods or services, the Customer agrees to be bound by these Terms.

Quotations

All quotations provided by Radiance are valid for 30 days from the date of issue. Radiance reserves the right to amend or withdraw any quotation at any time prior to the Customer’s acceptance.

Orders

Orders must be submitted in writing and signed by the Customer. Radiance reserves the right to refuse any order.

Prices

All prices quoted by Radiance are in Australian dollars and exclusive of GST unless otherwise stated. Radiance reserves the right to alter its prices at any time without notice.

Payment

Payment is due in full within 7 days of the invoice date. Radiance reserves the right to charge interest on overdue payments at a rate of 10% per annum.

Delivery

Radiance will make every effort to deliver goods and services within the agreed timeframe. However, Radiance will not be held responsible for any delays caused by factors beyond its control, such as adverse weather or strikes.

Risk

The risk in the goods transfers to the Customer upon delivery.

Warranty

Radiance warrants that all goods and services supplied by it will be free from defects in materials and workmanship for a period of 12 months from the date of delivery. This warranty does not cover defects caused by misuse, neglect, or accident.

Liability

Radiance’s liability for any loss or damage suffered by the Customer as a result of the supply of goods or services is limited to the cost of replacing or repairing the goods or services. Radiance will not be liable for any indirect or consequential losses.

Dispute Resolution

Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

Entire Agreement

These Terms constitute the entire agreement between the parties and supersede all prior agreements, representations, and understandings between the parties, whether written or oral.

Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck out, and the remaining provisions shall remain in full force and effect.

Waiver

No waiver of any provision of these Terms shall be effective unless in writing and signed by both parties.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia.

Additional Terms and Conditions

Radiance reserves the right to change these Terms at any time without notice.

The Customer acknowledges that they have read and understood these Terms and agrees to be bound by them.
